Beyond Tours Ltd shall only supply visa or tour services to you on the following terms and conditions, unless we agree, in writing to vary these terms and conditions.


  1. General Terms and Conditions
    1. Where an Agent engages the services of Beyond Tours on behalf of one or more clients, the agent acknowledges and agrees that Beyond Tours contracts solely with the Agent as principal and Beyond Tours shall have no personal liability to any client of the Agent. The Agent agrees to indemnify Beyond Tours against all claims of any kind caused or arising brought by any client of the Agent in relation to any act or omission by Beyond Tours or its agents and employees in connection with undertaking or performing any Visa Processing or Advisory Services for or at the request of the Agent. The Agent acknowledges and agrees that Beyond Tours' services are or will be acquired in connection with its travel agency business and that the provisions of the Consumer Guarantees Act 1993 are excluded and shall not apply to the Visa Processing and Advisory Services which Beyond Tours undertakes or performs for or at the request of the Agent.

    2. Under no circumstances shall Beyond Tours be liable for consequential loss or damage however caused or arising.

    3. Payment of accounts is required by the 20th of the following month. Should payment not be received, no further Beyond Tours services will be supplied until the overdue invoices have been paid in full. Should payment problems persist, the account will remain on a stop credit basis permanently and all future transactions will need to be on a cash sales basis only. Any passports currently held by Beyond Tours will only be released when arrears have been received in full. Any debit collecting fees will be the responsibility of the customer.

  2. Visa Services
    1. Beyond Tours will endeavour to provide the most accurate Visa Advice available.  However due to ever changing Visa Regulations, Beyond Tours will not be held responsible for information which subsequently becomes incorrect after advice has been given as a result of changes in Visa requirements.  No information can be stored on our website.

    2. Beyond Tours will not be held responsible for information supplied by Embassies or Consulates which is incorrect or inaccurate.

    3. In the unlikely event of a dispute regarding the accuracy or validity of any advice given by Beyond Tours, only advice or information in a documentary form will be considered when resolving the dispute and determining what, if any, compensation is appropriate for any inaccurate or incorrect information or advice.

    4. Beyond Tours will endeavour to process visas and passports in the shortest time whilst utilising the most reliable and secure methods of transport available to and from Embassies and Consulates.

    5. Whilst every reasonable effort will be made to ensure the safety of passports during processing and also to obtain visas or passports within the time required, Beyond Tours will not be held responsible for delays caused by or due to processing times at Embassies or Consulates, transportation, public holidays, incorrect or incomplete documentation, or any other cause beyond Beyond Tours' reasonable control. Beyond Tours will not be responsible for any prepaid travel arrangements, should the visa or the passport not be issued on time or declined.  In the event a visa or a passport application is declined, no Beyond Tours processing fee will be refunded, only money recovered from the Embassy will be refunded.  Beyond Tours will not be responsible for Embassy errors.  While every effort will be made to ensure the visa or the passport has been issued correctly, it is the client's responsibility to ensure the visa or the passport has been issued in accordance with their travel plans.

    6. Beyond Tours reserves the right to charge the Consular fee as requested by the Embassy on the day the visa is issued, plus any associated bank fees if applicable.

    7. In the event that a visa is not processed in time due to some act or omission on the part of Beyond Tours, Beyond Tours' maximum liability shall be to refund in full all Consular and / or Beyond Tours fees paid to process the visa in question.

    8. Beyond Tours will not be liable for any event of loss or damage to passport(s) whilst being processed.

    9. Beyond Tours will not be liable for any loss of documents once dispatched on completion of the job.

    10. Beyond Tours shall be entitled to make additional charges for exceptional circumstances such as return transportation costs when passports have to be sent by special delivery rates rather than in the normal course of work, or in extremely urgent cases where additional communication costs or extra waiting time at Consulates or Embassies is incurred.

  3. Tour Booking and Payment
    1. Book as early as possible by sending a non-refundable deposit of $250 per person to "Beyond Tours" and advising us of your full name, passport number, date of birth, nationality, address and any pre-existing medical conditions.

    2. On receipt of the above, your booking confirmation will be sent to you.

    3. The balance of the tour cost is due seven weeks prior to departure. On receipt of payment, we will supply you with your trip dossier and your visa support documents.

    4. The personal information provided to us will be held at our Auckland Office. We may use the information supplied to compile mailing lists and the provision of promotional material to you. Please note that you have the right under the Privacy Act 1993 to access, and request correction of, any personal information held by us concerning yourselves.

  4. What your Tour payment covers
  5. Your tour cost paid to us covers accommodation, transport, meals and sightseeing as described in our brochure. Please note that airfares costs are additional.

  6. What your Tour payment does not cover
  7. The tour cost paid to us does not cover any costs other than those described in paragraph 2. Some examples of costs not covered are airport taxes and fees, passports, vaccinations, insurance, tips, gratitude on ferries and cruise boats, excess baggage, extra meals, laundry, drinks, mini-bar charges, souvenirs, items of a personal nature including medication, optional excursions and porterage at airports.

  8. Cancellations and changes to travel plans by you
    1. Should you wish to cancel your booking, there is a cancellation fee as follows:

      • Cancellation more than 6 weeks before departure incurs a fee of $250 (deposit)

      • Cancellation less than 6 weeks before departure incurs a fee of 40% of the total tour cost

      • Cancellation less than 4 weeks before departure incurs a fee of 65% of the total tour cost

      • Cancellation less than 14 days before departure incurs a fee of the total tour cost.

      We will refund you any amount you have paid over and above the relevant cancellation fee.

    2. Should you wish to alter your tour after your original booking, you should notify us in writing. We will endeavour to accommodate you, however, we do not warrant that your alterations will be possible. Further, there is an administrative cost of $25 per amendment plus any additional costs your alterations incur. If we are not able to accommodate the changes to your travel plans, and you cancel your booking as a result, the cancellation fees set out above will apply.

    3. No refund will be given if you voluntarily leave a tour for any reason after the tour has begun. No refund will be made for any accommodation, transport, sightseeing, meals or services not utilised.

    4. If you are involuntarily forced to leave a trip for a reason other than your personal circumstances, we may, at our absolute discretion, provide you with a refund or partial refund.

  9. Cancellations and changes to travel plans by us
    1. We reserve the right to cancel any tour due to:

      1. failure to obtain the minimum number of fully-paid travellers;

      2. terrorism, natural disasters, political instability or other external events which make it unviable or unsafe for us to operate our planned tour.

      In such a case, we may, at our absolute discretion, refund the tour cost. We shall not be liable to you for any other costs you have incurred incidental to preparing for the tour, such as airfares (in the case of airfares, please refer to the appropriate airline for their refund policy).

    2. If, after tour departure, the services included in the tour cannot be supplied, or there are changes in an itinerary for reasons beyond our control, we will arrange for the provision of comparable services. Any resulting additional expense will be payable by you and any resulting saving will be refunded to you.

  10. AirFares
  11. While we can assist you with arranging airfares (costs of airfares are not included in price of our tours) these terms and conditions apply to the land component of our tour only. The terms of the relevant airline apply to the air travel component of our tour.
